LitigationWhen the situation calls for litigation, TFW prides itself in its ability and eagerness to pursue the interests of its construction clients in that setting. TFW has tried many construction cases and is proud of its ability to do so. Alternative Dispute ResolutionIn TFW’s experience, approximately 30% of construction disputes are resolved by arbitration. TFW has extensive experience representing clients in the arbitration process. Often the Rules of the American Arbitration Association for the Construction Industry are incorporated directly or indirectly into construction contracts, and TFW has a thorough understanding of the letter and spirit of the AAA Rules as they apply to construction disputes. Of course, a vast majority of construction disputes are referred to mediation voluntarily or by court order, and TFW frequently represents clients in the mediation process as well.
